Welcome to the stable! The Lucky Fox Farm Liability Release is compiled for the safety of customers, staff and horses. Take your time to familiarize yourself with the following information, don´t hesitate to contact the staff if any questions should arise.
1. Please take notice of the opening hours of the stable. During the open hours the staff is at the stable to help you. Information you get from the staff is essential for everybodys safety.
2. Calm and composed behaviour is essential around horses. Horses are flight animals that can spook at sudden movements and loud noises.
3. Dogs should be on the leash while visiting the stables, it is important for dogs own safety.
4. Feeding is planned carefully for each horse individually. Feeding extra grain could risk horses health or change horses behaviour, treats such as horse treats, apples, carrots, etc. are welcomed.
5. Every horse has it´s own, fitted tack. Please put away all tack correctly. You may ride in your own tack if approved and fitted to the horse by a trainer.
6. While handling the horses, be aware of the surroundings and try to anticipate and avoid situations that may couse danger to yourself, the horse or the others. Ask questions without hesitation or prejudice, attend courses, trainings and events organized by your stable in order to learn more about horses and handling of horses.
LUCKY FOX FARM LIABILITY RELEASE
This document waives important legal rights. Read it carefully before signing.
1, I do hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE: Marianne England, Amanda Strube, Rachel Miller, and Richard Miller d/b/a Lucky Fox Farm; Thomas or Bonnie Ogles their operators, horse owners, investors, agents, employees, lessees and participants (all hereafter collectively referred to as RELEASEES) from any and all claims, of whatsoever kind or nature in law, equity, or otherwise, whether now known or unknown, arising out of any liability or negligence of RELEASEES which causes the undersigned injury, death, or damages.
I am fully aware and acknowledge that horse activities involve inherent dangerous risks of accidents, loss, and serious bodily injury including, but not limited to, broken bones, head injuries, trauma, pain, suffering, or death (hereinafter "Harm"). This Release covers, but is not limited to, inherent risks of equine activity which means a danger or condition that is an integral part of equine activity, including but not limited to, any of the following:
1) The propensity of an equine to behave in ways that may result in injury, death, or loss to persons on or around the equine;
2) The unpredictability of an equine's reaction to sounds, sudden movement, unfamiliar objects, persons, or other animals;
3) That conditions of horseback riding and horses change from time to time and may become more hazardous,
I fully understand that my entry onto the farm or premises of Releasees and riding in or attending horse shows involves DANGER AND RISK OF INJURY OR DEATH and that there is inherent danger in being around and in riding horses which I appreciate and VOLUNTARILY ASSUME. I have observed horses and riding of the type that I seek to participate in and have inspected the grounds, horses, and equipment. I further acknowledge that other riders and participants pose a danger to me and I VOLUNTARILY elect to assume all risks connected to my participation in equine activities.
l agree to indemnify Releasees and to hold Releasees harmless from any claim, judgment , or expense, including attdrney's fees and costs of litigation that may arise out of my activities or presence on the farm, or travel to or from the property of Releasees, or at horse shows or other horse related events. I agree that neither I, nor anyone claiming thlough me, will hereafter bring, commence, prosecute, maintain, or cause or permit to be brought, any suit or action in any court against Releasees on account of, arising out of, or in any way connected with any Harm to me.
I expressly agree that this Release is intended to be as broad and inclusive as permitted by the law of the state in which I participate in activities conducted by the Releasees and that if any provision of this Release is found to be invalid a court of competent jurisdiction, the remaining provisions shall be construed as if the affected provision had not been included in order to effectuate the intent of the parties.
WARNING: Under Tennessee Law, an equine professional is not liable for an injury to or death of a participant in equine activities resulting from the inherent risks of equine activities pursuant to Tennessee Code Annotated, Title 44, Chapter 20, Section 1.
I acknowledge that I enter into this Release after having read same, and place my signature hereto of my own free voluntary act and deed. By signing below, I represent that I fully understand its contents and that I do not need any further explanation.
